Eligibility: You must be at least 18 years old to create an account. The Service is intended for use by adults, including parents, teachers, and educational staff.

Data Input Rules: When using our observational tools, you agree to strictly follow our Privacy Policy by using non-identifiable identifiers (such as initials or pseudonyms) for any children. You must not input full names or directly identifiable sensitive health data into the platform.

4. Subscriptions and Payments

Billing: We offer paid subscription plans to access premium features. All payments are securely processed by our third-party payment provider, Stripe. We do not store your credit card details.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless you cancel your subscription before the renewal date.
Cancellations: You may cancel your subscription at any time via your account settings. Upon cancellation, you will retain access to the premium features until the end of your current paid billing period.
Refunds: All subscription fees are non-refundable. We do not provide prorated refunds for partial months of service or unused accounts.

Not Professional Advice: The Learning Fort provides software tools, including the Sensory Indicator, designed to assist with observational tracking and educational support. The outputs generated by the Service do not constitute formal medical, psychological, diagnostic, or professional special educational needs (SEN) advice.
No Replacement for Practitioners: Our tools are strictly for informational and structural support. They are not a substitute for formal assessments by qualified healthcare providers, occupational therapists, psychologists, or educational specialists. You agree not to use the Service as the sole basis for any medical or educational intervention.

You agree not to use the Service to:

Violate any applicable national or international law.
Attempt to reverse engineer, decompile, or hack the software, or bypass our security measures.
Share your account credentials with unauthorised users (e.g., sharing a single personal subscription across an entire school staff).
Upload or transmit any malicious code, viruses, or harmful data.

7. Intellectual Property

All intellectual property rights in the Service, including the codebase, designs, branding, and the methodology behind the Sensory Indicator, are the exclusive property of The Learning Fort. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, or resell any part of the Service.

To the maximum extent permitted by Irish law, The Learning Fort and its owner shall not be held personally or commercially liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

Your use of or inability to use the Service.
Any decisions or actions taken based on the outputs generated by the Service.
Any unauthorised access to or alteration of your data.

In no event shall our aggregate liability exceed the total amount paid by you to us for the Service during the twelve (12) months immediately preceding the claim.

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you breach any of these Terms. Upon termination, your right to use the Service will cease immediately.
